The Scheduling Institute TERMS AND CONDITIONS (also referred to as Terms of Service)

EFFECTIVE JUNE 16, 2023

 

TERMS OF SERVICE FOR ALL PRODUCTS

I represent and warrant that: (i) I have read and understand these Terms of Service; (ii) I have full legal authority to accept these Terms of Service on behalf of myself and/or any entity to which such Services will be provided; and (iii) I agree to these Terms of Services on behalf of myself and/or any entity to which such Services and agree to abide by, and be bound by, same.. By accepting any services from The Scheduling Institute, I acknowledge my receipt of, and my agreement to, these Terms of Service on behalf of myself and/or any entity to which such Services are provided. [If you don’t have the legal authority to agree to these Terms of Service, please do not sign or accept same.]

By accepting terms these Terms of Service with The Scheduling Institute, I agree to the terms of The Scheduling Institute and the selected product as documented in an associated order form and in these Terms of Service.

These Terms of Service apply to all products and programs that I purchase from The Scheduling Institute. I also understand and agree to the additional terms that apply to the specific product I am purchasing from The Scheduling Institute.

Your Responsibility to Comply with Laws Requiring Consent to Record and Disclose Telephone Calls.

I UNDERSTAND AND ACKNOWLEDGE THAT CERTAIN COMMUNICATION, DATA PROTECTION AND PRIVACY LAWS WHERE I LIVE MAY IMPOSE CERTAIN RESPONSIBILITIES ON ME AND MY USE OF THE PRODUCTS AND SERVICES, INCLUDING THE CALL TRACKER OR SCHEDULING INSTITUTE 5 STAR CERTIFICATION PRODUCTS. I AGREE THAT I (AND NOT THE SCHEDULING INSTITUTE) AM RESPONSIBLE FOR COMPLYING WITH, AND WILL COMPLY WITH, ANY SUCH APPLICABLE LAWS, INCLUDING BUT NOT LIMITED TO (I) ANY LAWS RELATING TO THE RECORDING OR SHARING OF AUDIO CONTENT THAT INCLUDES EMPLOYEES OR THIRD PARTIES, OR (II) ANY LAWS REQUIRING NOTICE TO OR CONSENT OF EMPLOYEES OR THIRD PARTIES PRIOR TO RECORDING TELEPHONE CALLS OR THE USE OF THE PRODUCTS. I UNDERSTAND, ACKNOWLEDGE AND AGREE THAT THE SCHEDULING INSTITUTE EXPRESSLY DISCLAIMS ANY RESPONSIBILITY FOR INFORMING ME OF THE REQUIREMENTS OF MY LOCAL LAWS AND/OR ASSURING MY COMPLIANCE WITH SUCH LAWS.

Additionally, I understand and acknowledge that The Scheduling Institute requires me to obtain from all my employees’ express consent to the recording and sharing of inbound and outbound calls prior to utilizing the Scheduling Institute’s Services.  I agree to obtain such consent from my employees and, by utilizing Scheduling Institute’s Services, warrant that I have done so.

Payment Terms

I agree to the Payment terms described in the order form corresponding to my selected product or program. I authorize The Scheduling Institute to auto-charge my account using the payment method selected on the order form, according to the terms outlined on the order form and herein. I understand that all prices are listed in US Dollars. I understand and agree that, if the payment method selected on the order form is declined for any reason, The Scheduling Institute may charge any of the other credit/debit cards I have on file with my account. The Scheduling Institute is not responsible for overdraft or other penalties/fees that I may incur for such charges (or attempted charges). Notwithstanding the fact that all purchases are non-refundable, in the event that The Scheduling Institute decides, in its sole discretion, to provide me with any refund in the event of a cancellation of a purchase, I understand that services that were utilized will be valued at list price when reducing the original sales price (not discounted cost) for calculation of refund amounts.

No Guarantees

Unless there is a specific guarantee provided in the terms and conditions below, or on my signed sales order form, I understand and acknowledge that The Scheduling Institute makes no guarantees regarding the outcomes or results that I will obtain or achieve as a result of the product or program I am purchasing from The Scheduling Institute. I understand that, in some instances, a guaranteed result will be documented on my order form or order web page. I understand that, in these instances, The Scheduling Institute may recommend that I implement additional programs and products and/or provide me with additional services to achieve the guaranteed result. I agree to implement any recommended programs and products, and to accept any additional services, offered at no additional cost to me to achieve the guaranteed result. I understand that I am responsible for implementing the programs and products according to The Scheduling Institute’s recommendations and providing results to The Scheduling Institute as required in the terms and conditions below, on my sales order form, or those documented in the product materials provided to me.

Communications and Privacy

I agree to receive marketing, service, commercial, and other communications from The Scheduling Institute via facsimile, email, regular mail, or other electronic means, including an automatic telephone dialing system or an artificial prerecorded voice, unless I submit an electronic or other written request to opt out of receiving them.

I understand that The Scheduling Institute respects the privacy of its users when they use its websites and mobile and other online applications, products, and services. I acknowledge that I have been provided with The Scheduling Institute’s Privacy Statement, and I consent to the use of my information and information about me in accordance with the Privacy Statement.

Ownership Rights and Confidentiality

I understand and agree that any and all intellectual property rights associated with Scheduling Institute materials, including but not limited to training materials, are the sole and exclusive property of The Scheduling Institute. The Scheduling Institute’s materials are protected by federal, state and international copyright and other laws. Except as otherwise expressly permitted by these Terms, I agree not to sell, offer for sale, reproduce, lease, create derivative works from, upload, transmit, display, publish or distribute any Scheduling Institute materials, in whole or in part, in any way, without prior written permission of The Scheduling Institute. I acknowledge and agree that I receive a limited, personal, nontransferable, non-assignable, revocable right to access and use Scheduling Institute materials for purposes related to my participation in The Scheduling Institute’s programs. Any access or use that is inconsistent with these terms is unauthorized and strictly prohibited.

Limitation of Liability

Except as caused by gross negligence or intentional misconduct, The Scheduling Institute will not be liable for any indirect, incidental, special, consequential or exemplary damages (including damages for loss of profits, goodwill, use, or data), even if it has been advised of the possibility of such damages. Further, The Scheduling Institute shall not be responsible for any damages arising in connection with any unauthorized access to, alteration of, or the deletion, destruction, damage, loss or failure to store any of my company’s information, including but not limited to protected health information, unless caused by The Scheduling Institute’s gross negligence or intentional misconduct. In all events, The Scheduling Institute’s aggregate liability under these Terms will be limited to two times the amount my company actually pays The Scheduling Institute for the service that gave rise to the claim during the twelve (12) months preceding the claim.

Dispute Resolution

Any disputes involving my company’s enrollment or participation in the program or regarding these Terms of Service shall be governed by the substantive law of Georgia. The exclusive forum for any lawsuit relating to such a dispute shall be the state or federal courts of Georgia. My company and I submit to personal jurisdiction in Georgia in connection with any such lawsuit.

INDEMNITY.

I agree to defend, indemnify and hold The Scheduling Institute and its licensors and suppliers harmless from any damages, liabilities, claims or demands (including costs and attorneys’ fees) made by any third party due to or arising out of (i) my use of the Products or Services, (ii) my violation of these Terms, (iii) any User Submissions or Feedback I provide; or (iv) my violation of any law or the rights of any third party. I understand, acknowledge and agree that The Scheduling Institute reserves the right, at my expense, to assume the exclusive defense and control of any matter for which I am required to indemnify The Scheduling Institute and I agree to cooperate with the defense of such claims. I agree not to settle any such claim without The Scheduling Institute’s prior written consent. I understand, acknowledge and agree that The Scheduling Institute will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

ADDITIONAL TERMS OF SERVICE FOR TRAININGS

In addition to the Terms of Service for all products listed above, I also agree to the following additional Terms of Service for the training(s) I am purchasing from The Scheduling Institute.

Payment

Each training purchased must be paid for four weeks prior to the scheduled training date.   If purchased as part of a bundle, the prorated portion of the bundle price must be paid. For example, if you have purchased a four training bundle, and are prepared to do a second training, one half of the original bundle price will need to be paid four weeks prior to the second training. If I decide to cancel my purchase, I agree to pay a non-refundable $1,000 deposit for each onsite training day purchased. I understand that The Scheduling Institute is agreeing to commit substantial resources and provide valuable materials to my company, the value of which is difficult to ascertain at the time of my order. I therefore acknowledge that The Scheduling Institute’s retention of the non-refundable portion of the total training price in the event of my company’s cancellation is not a penalty, but rather a reasonable measure of damages likely to be caused by my cancellation.

 

Travel Expenses

I understand that standard travel expenses for training sessions conducted in the continental United States and Canada are included in the pricing of each in-office training day. For Alaska and Hawaii there will be an additional $1000 travel charge. Any travel expenses above $1,000 for countries outside the United States and Canada will be billed to my account. Certain countries outside the United States may require additional visa costs and special fees and taxes.   I understand these costs are not included in the pricing and acknowledge these fees will be billed to my account.

Rescheduling

Should I decide to change a scheduled training date or type within 30 days of the scheduled date (6 weeks for trainings outside United States and Canada), I understand that The Scheduling Institute will charge a $1,000 fee per training day for re-scheduling.

Premium Trainings

The following trainings are considered Premium.   If any bundle or individual purchase of a standard training is upgraded to a Premium training there will be an additional charge based on the price of the premium training. Below is the list of premium trainings:

  • Accounting
  • Cash Flow Management

Limitations of Numbers and Locations of Attendees

Scheduling Institute trainings differ in participation requirements. Most trainings are designed for single offices and a maximum number of attendees. I understand that, if my selected training is listed below and exceeds 25 participants, multiple trainers and additional training materials will be required at an additional cost.

Below is a list of trainings that will incur additional costs if they exceed 25 participants:

  • New Patient/5 Star Telephone (max of 12 of the 25 people who consistently answer the phone)
  • Advanced Telephone
  • New Patient Experience
  • Case Acceptance
  • Live Coaching Day 1 or 2 day option
  • 5X Clarity Retreat
  • Platinum Clarity Retreat
  • Annual Leadership Planning
  • Quarterly Leadership Facilitation Retreat
  • Hygiene Mix of Services
  • Hygiene Profitable Perio
  • Retention, Recare, & Reactivation
  • Hygiene Vision & Growth
  • Efficiency & Streamlining
  • Live Scheduling Day
  • Clinical Live Coaching

The following trainings have additional costs for materials if the number of participants exceeds 15, and also require multiple trainers if the number of participants exceeds 25:

  • T.E.A.M Training
  • T.E.A.M. Advanced Leadership

The following trainings should not be held when participants are located in different offices.   These factors diminish the training effectiveness, and cannot be offset by having additional trainers:

  • New Patient Experience
  • Case Acceptance
  • Live Coaching Day 1 or 2 day option
  • Hygiene Vision & Growth
  • Efficiency & Streamlining
  • Live Scheduling Day
  • T.E.A.M Training
  • T.E.A.M. Advanced Leadership
  • Clinical Live Coaching

I understand that, even though additional trainers can be provided at additional costs, Scheduling Institute trainings are not designed to exceed 50 participants.  If more than 50 participants, a custom training will need to be designed.

Outsiders attending trainings – I understand The Scheduling Institute must approve anyone not currently employed with my office attending a training.  It is my responsibility to receive approval in advance, and ensure the participant sign a Scheduling Institute provided NDA prior to the training.  I also understand that The Scheduling Institute has the right to exclude outsiders from attending trainings.

Recordings – Scheduling Institute trainings can’t be recorded in any format, and none of the training materials can be copied.

ADDITIONAL TERMS OF SERVICE FOR THE SCHEDULING INSTITUTE SEMINARS, BOOTCAMPS, AND THE U

I acknowledge that The U and 2019 Results Creator Bootcamps are annual programs that starts on January 1st of the calendar year and ends on December 31st of the calendar year (regardless of my date of enrollment in the program.)

I understand my program enrollment eligibility is only valid if I remain in either the Platinum or 5X Membership throughout the program’s calendar year. I understand that if I choose to unenroll from the Platinum or 5X Membership that I must immediately forfeit any unused portion of the U program benefits without penalty to The Scheduling Institute.

I acknowledge that I will remain responsible for payment of the entire cost of The U program and 2019 Results Creator Bootcamp, regardless of the payment plan I selected. I also acknowledge that this fee is non-transferable and non-refundable regardless of program completion or my activity level and attendance at events. I also acknowledge that The Scheduling Institute is agreeing to commit substantial resources and provide valuable materials to my company, the value of which is difficult to ascertain at the time of my enrollment. I therefore acknowledge that The Scheduling Institute’s collection and retention of the entire program fee in the event of my company’s cancellation is not a penalty, but rather a reasonable measure of damages likely to be caused by my cancellation.

I understand that, The Scheduling Institute reserves the right to change the program at any time (including cancellation of workshops and events) without notice. I understand that, The Scheduling Institute reserves the right in its sole discretion to add, limit, or remove program benefits without notice.

ADDITIONAL TERMS OF SERVICE FOR EVENTS

In addition to the Terms of Service for All Products listed above, I also agree to the following additional Terms of Service for the event(s) I am purchasing from The Scheduling Institute.

Payment

I agree that each event I purchase must be paid for in full prior to my attendance at the event, regardless of the amount of payment included with the sales order, unless otherwise stated on registration form.

I understand that I cannot get a refund if I cancel an event within 90 days of the scheduled event date and any payment made may not be repurposed for payment of purchase of any other Scheduling Institute event, product or service.

ADDITIONAL TERMS OF SERVICE FOR CALL TRACKER SUBSCRIPTION

In addition to the Terms of Service for All Products listed above, I also agree to the following additional Terms of Service for the Subscription that I am purchasing through The Scheduling Institute.

Payment

I understand that, depending on the terms of my Call Tracker subscription (monthly or yearly), my subscription will be automatically renewed on a monthly or yearly basis. I authorize The Scheduling Institute or their billing providers to auto-charge my account using the payment method selected on the order form, according to the terms outlined on the order form, at the time of automatic renewal.

I understand that my credit card on file will be charged for overages based upon usage in excess of what is included in my selected plan. All prices are in U.S. dollars.

Promotional Pricing

I understand that any promotional pricing is valid for one year, and that my Call Tracker subscription will be automatically renewed on a monthly or yearly basis (depending on the terms of my subscription) at the current price and without any promotional discount, upon expiration of the term of such promotional pricing.

Contract and Cancellations

I agree that, I can’t cancel a prepaid yearly subscription for a refund.  I agree that a 30-day written notice via email to calltracker@schedulinginstitute.com, is required to cancel a monthly subscription.

I understand that monthly billing products are billed in advance, and that I will not receive a refund for partial month usage.

Call Tracker Monitoring

I understand that The Scheduling Institute uses call measurement and recording services to facilitate its Call Tracker Program. The Scheduling Institute may use third party vendors (which vendors have a subcontractor Business Associate Agreement with The Scheduling Institute) to assist in this process. I further understand that personal information, including Protected Health Information (PHI), may be recorded during my calls.

The Scheduling Institute shall use commercially reasonable efforts to make access to the Services available through the required access protocols but makes no warranty or guarantee that (i) the Services will be available at any particular time; or (ii) you will be able to access the Services at any particular time or from any particular location. Scheduling Institute will not be liable for any act or omission of any other company or companies furnishing a portion of the Services (including, without limitation communications carriers or ISPs), or from any act or omission of a third party, including those vendors participating in Scheduling Institute offerings made to you, or for equipment that it does not furnish, or for damages that result from the operation of customer-provided systems, equipment, facilities or services that are interconnected with the Service.

NOTWITHSTANDING ANYTHING CONTAINED HEREIN TO THE CONTRARY, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OR CONDITIONS WHATSOEVER, EXPRESSED OR IMPLIED. NOTWITHSTANDING THE FOREGOING OR ANY STATEMENT TO THE CONTRARY CONTAINED IN THESE TERMS, SCHEDULING INSTITUTE DOES NOT WARRANT THAT THE USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE, INCLUDING, BUT NOT LIMITED TO ANY INTERRUPTIONS TO THE SERVICES CAUSED BY THE INTENTIONAL AND/OR MALICIOUS ACTS OF THIRD PARTIES (E.G., “HACKING”) NOR SHALL SCHEDULING INSTITUTE BE RESPONSIBLE FOR ANY DATA LOSS OR LOSS OF ANY INFORMATION IN YOUR ACCOUNT, REGARDLESS OF THE CAUSE. FURTHERMORE, SCHEDULING INSTITUTE MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES OR THAT THE SERVICES WILL MEET ANY OF YOUR SPECIFIC REQUIREMENTS OTHER THAN AS MAY BE EXPRESSLY SET FORTH IN THESE TERMS. SCHEDULING INSTITUTE MAKES NO REPRESENTATIONS OR WARRANTIES AND HEREBY DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES OF ANY KIND, WHETHER EXPRESS, STATUTORY OR IMPLIED, ORAL OR WRITTEN, WITH RESPECT TO THE SERVICES, INCLUDING WITHOUT LIMITATION ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE MATERIAL, SERVICE, SOFTWARE, TEXT, GRAPHICS OR LINKS, AND ALL WARRANTIES IMPLIED FROM ANY COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE. SCHEDULING INSTITUTE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM LOSS OF USE OR LOST BUSINESS, LOSS OF OPPORTUNITY, LOSS OF REVENUE, LOSS OF ACTUAL OR ANTICIPATED PROFITS, LOSS OF DAMAGE TO OR CORRUPTION OF DATA OR LOSS OF GOODWILL), OR FOR ANY COST OF PROCUREMENT OF SUBSTITUTE SERVICES ARISING IN CONNECTION WITH THESE TERMS, WHETHER IN AN ACTION IN CONTRACT, TORT, STRICT LIABILITY OR NEGLIGENCE, OR OTHER ACTIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF THE SERVICES RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT, SOFTWARE, OR DATA, SCHEDULING INSTITUTE IS NOT RESPONSIBLE FOR THOSE COSTS. TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SERVICES FOR DIRECT DAMAGES SHALL NOT, IN THE AGGREGATE, EXCEED AN AMOUNT EQUAL TO THE MONTHLY TRANSACTION FEE PAID BY YOU TO THE SCHEDULING INSTITUTE HEREUNDER.


 

2023 Collections-Based Program Terms and Condition

 

A. Special Program Terms and Conditions.

The following Terms and Conditions shall apply to The Scheduling Institute’s 2023 Collections-Based Program (the “Program”).  These Special Program Terms and Conditions are intended to supplement, but not supersede or supplant, The Scheduling Institute’s General Terms and Conditions, which are available at https://schedulinginstitute.com/.  Except with respect to the specific matters addressed in these Special Program Terms and Conditions, The Scheduling Institute’s General Terms and Conditions shall govern your relationship with The Scheduling Institute.  To the extent any conflict exists between these Special Program Terms and Conditions and The Scheduling Institute’s General Terms and Conditions, the General Terms and Conditions shall control.

B. The Scheduling Institute Growth Guarantee.

The Program is a two (2) year program which requires a two (2) year commitment from you.  Your enrollment in the Program commences upon your first invoice payment.  As an incentive for your enrollment in the Program, The Scheduling Institute provides the following Growth Guarantee, subject to and expressly conditioned upon your fulfillment of the Growth Guarantee Requirements outlined in section (C), below:

By the end of the two (2) year period of your enrollment in the Program, your practice’s Collections* will have increased by an amount equal to at least the cost of your enrollment in the Program.  

*For purposes of the Growth Guarantee, your Collections will be calculated as the average of (i) your total annual collections; for (ii) the two years preceding your enrollment in the Program.  For example, if your practice’s annual collections in the two years preceding your enrollment in the Program equaled $700,000.00 and $500,000.00, respectively, then your Collections, for purposes of the Growth Guarantee, would equal $600,000.00, calculated as follows: $700,000.00 + $500,000.00 / 2 = $600,000.00.  For purposes of enabling the Scheduling Institute to calculate your Collections, you agree that, upon your enrollment in the Program, you will provide The Scheduling Institute with sufficient data, information and records to enable The Scheduling Institute to validate your Collections to its satisfaction, including but not limited to any specific data, information or records that The Scheduling Institute requests from you.

If you fulfill the Growth Guarantee Requirements outlined below but, by the end of your two (2) year enrollment in the Program, your practice’s Collections have nevertheless not increased by an amount equal to at least your Program enrollment costs, then you will be entitled to a prorated refund of those Program enrollment costs in an amount equal to (1 – (Collections Growth / Enrollment Costs)). You acknowledge and agree, however, that under no circumstances shall you be entitled to a refund in an amount greater than the Program enrollment costs that you paid.  You further acknowledge and agree that the Growth Guarantee is a special incentive that applies only to the Program, and not to any other products or services offered by The Scheduling Institute or purchased by you from the Scheduling Institute.

C. Growth Guarantee Requirements.

You understand and acknowledge that The Scheduling Institute’s obligation to satisfy the Growth Guarantee is subject to, and conditioned upon, your fulfillment of the Growth Guarantee Requirements listed below.  Your failure to fulfill any of the Growth Guarantee Requirements, as determined by The Scheduling Institute in its sole and absolute discretion, will operate to void the Growth Guarantee.  In the event your failure to fulfill any of the Growth Guarantee Requirements operates to void the Growth Guarantee, you understand and agree that you shall not be entitled to any refund of your Program enrollment costs.

During your enrollment in the Program, you agree to:

  1. Fulfill all Program requirements as outlined and described in the Program materials;
  2. Implement all recommendations made by The Scheduling Institute during the course of your enrollment in the Program, including recommendations regarding the utilization of additional products or services offered to you at no additional cost to facilitate the achievement of your practice’s target growth;
  3. Provide The Scheduling Institute with sufficient verifiable data, information and/or records to enable it to calculate your Collections and measure your practice’s progress toward its target growth;
  4. Submit all required monthly data, information and/or records by the 5th day of each month during your enrollment in the Program; and
  5. Immediately address any identified operational problems or other issues that are impeding your practice’s progress toward its target growth.

D. Invalidation of Growth Guarantee for Material Adverse Events
.

The Scheduling Institute extends the Growth Guarantee based on the current state of your practice and its existing operations.  You acknowledge and agree that your practice and its operations may be disrupted by certain material adverse events, including material adverse events unforeseen to and beyond the control of the parties, that render completion of the Program and/or achievement of target growth impracticable or impossible.  You understand and agree that the occurrence of a material adverse event, including but not limited to those enumerated below, will invalidate the Growth Guarantee:

  1. Force Majeure, including natural causes (g., fire, storms, floods, pandemics), governmental or societal actions (e.g., war, invasion, civil unrest, labor strikes), infrastructure failures, or other unforeseeable events that prevent the fulfillment of Program requirements or impede the achievement of target growth;
  2. Prolonged illness, incapacity or death of practice owners/principals;
  3. Reduction of practice capacity (g., reduction of doctors, hygienists, operatories or days or hours of operation);
  4. Major legal or personal disruptions (g., business dispute, divorce, eviction or litigation) that limit your participation in the practice and/or the Program or which otherwise impede achievement of target growth; or
  5. Sale of practice.*

*In the event of a practice sale, The Scheduling Institute will issue you a refund of any prepaid Program costs for any unfinished portions of the Program upon its receipt of a notarized closing statement confirming the sale of the practice.  If, at the time of such sale, you have not paid for any completed portions of the Program, you agree to do so as a condition of the cancellation of your two (2) year Program commitment. 

E. Auto-Renewal of Program Enrollment.

The Scheduling Institute offers a discount on the cost of the Program if you elect to automatically renew your enrollment in the Program for an additional two (2) year term.  You understand and agree that if you select the “Auto Renewal” option on your order form, and choose to receive the accompanying discount, then you are obligated to the re-enroll in the Program for an additional two (2) term at the recommended level based on your practice’s Collections.

 


 

 

  • Platinum Membership

I acknowledge that my Platinum Membership is a 36-month program made up of three 12-month terms, and that I will remain responsible for payment of the entire cost of each term, regardless of the payment plan I select, and regardless of program completion or my activity level and attendance at events or workshops. I also acknowledge that The Scheduling Institute is agreeing to commit substantial resources and provide valuable materials to my company, the value of which is difficult to ascertain at the time of my enrollment. I therefore acknowledge that The Scheduling Institute’s collection and retention of the entire membership fee in the event of my company’s cancellation is not a penalty, but rather a reasonable measure of damages likely to be caused by my cancellation.

  • 5x Membership

I acknowledge that my 5x Years is a 24-month program as is non-cancelable.  I also acknowledge that this fee is non-refundable regardless of program completion or my activity level and attendance at events and workshops. I acknowledge that I am receiving a substantial discount on the actual a la carte cost of the services that I will receive through the program. I also acknowledge that The Scheduling Institute is agreeing to commit substantial resources and provide valuable materials to my company, the value of which is difficult to ascertain at the time of my enrollment. I therefore acknowledge that The Scheduling Institute’s retention of the entire membership fee in the event of my company’s cancellation is not a penalty, but rather a reasonable measure of damages likely to be caused by my cancellation.

  • Gold Plus

If you have received a written guarantee associated with your order, you must abide by all of the following requirements to receive a refund:

  1. My company must complete all the New Patient Mastery/5-Star Telephone On-Site Training and the New Patient Experience On-Site Training
  2. My company must complete the entire 6-month program.
  3. My team must reach Certification within 90 days of the New Patient/5 Telephone On-Site Training and must maintain a 4- or 5-star rating on all calls made to my office during the membership period.
  4. My team must be re-certified every 6 months.
  5. My company must submit monthly statistics by the 5th day of the month for the previous month, for the entire 6-month program.
  6. Throughout the 6-month Gold Plus Membership, The Scheduling Institute’s team may make recommendations to my company to increase capacity and/or update our office to encourage growth or make human capital changes. My company must follow and implement these recommendations.
  7. The Scheduling Institute’s team will make internal and external marketing recommendations during my membership. My company must implement the specific components of any such plan.
  8. The Dr must attend the New Patient Mastery Telephone On-Site Training

I understand that the purchase of this program entitles me to a free 180-day Scheduling Institute Membership at the Gold level, which starts once the kit is shipped. I further understand that, after 180 days, I will be charged $249 per month for the membership unless I contact The Scheduling Institute to cancel the membership. A 30-day written notice sent to info@schedulinginstitute.com is required.

I further acknowledge that this is a 6-month program, and that I will remain responsible for payment of the entire cost of the program, regardless of the payment plan I select, and regardless of program completion or my activity level and attendance at events. I understand that the purchase of the Self Implementation Kit entitles me to a free 90-day Scheduling Institute Membership at the Gold level. I further understand that, after the 90 days, I will be charged $249 per month for the membership unless I submit cancellation to The Scheduling Institute in writing via email to info@schedulinginstitute.com 30 days in advance.

If you have received a written guarantee associated with your Telephone Training Self Implementation Kit order, you must abide by all of the following requirements to receive a refund:

  1. My company must complete all Telephone Training Materials.
  2. My company must complete the entire 90-day program.
  3. My team must reach Certification within 90 days and must maintain a 4- or 5-star rating on all calls made to my office.
  4. My company must submit monthly statistics by the 5th day of the month for the previous three months.
  5. My team will complete all the steps required in the first 3 months of the program, and implement it as designed, including calls from Member Service resource, incentives, and other required steps.

I have 90 days to return the kit in original condition to receive a full refund minus shipping and handling.   If the kit is damaged, there will be a restocking fee. I understand that, if the kit is damaged or any materials are missing from the kit, I will not receive a refund. I understand that the purchase of this program entitles me to a free 90-day Scheduling Institute Membership at the Gold level, which starts once the kit is shipped. If you have received a written guarantee associated with your New Patient Mastery/5-Star Telephone Training, you must abide by all of the following requirements to receive a refund:

  1. All Members of my company’s front desk attend the Telephone Training.
  2. Each member of my team must achieve Certification within 90 days of the Telephone On-Site Training and must maintain a 4- or 5-star rating on all calls made to my office.
  3. My company must submit monthly statistics by the 5th day of the month, starting the month after the training, and continue making this submission each month thereafter for 90 days.
  4. My team will complete all the steps required in the first three months of the program, and implement it as designed, including calls from Client Service resources, incentives, and other required steps.

I understand that the purchase of this program entitles me to a free 90-day Scheduling Institute Membership at the Gold level, which starts once my team is trained. I further understand that, after 90 days, I will be charged $249 per month for the membership unless I contact The Scheduling Institute to cancel the membership. A 30-day written notice sent to info@schedulinginstitute.com is required.

ADDITIONAL TERMS OF SERVICE FOR BLUEPRINT DAYS

In addition to the Terms of Service for “All Products” listed above, I also agree to the following additional Terms of Service which apply to any Blueprint Days that I am purchasing from the Scheduling Institute.

Payment

I acknowledge and agree that I must pay the full purchase price for each Blueprint Day I purchase prior to the date of the scheduled event, regardless of the amount of payment included within the sales order, unless otherwise stated on the registration form.  I acknowledge and agree that Blueprint Day purchase, including deposits and payments, are non-refundable.

Rescheduling

I acknowledge and agree that Blueprint Days may not be rescheduled except according to the following terms.

I acknowledge and agree that Blueprint Days may only be rescheduled twenty-one (21) days prior to the scheduled event.  If I do not reschedule a Blueprint Day twenty-one (21) days prior to the scheduled event, I acknowledge and agree that I forfeit any deposit and/or payment I have made towards such Blueprint Day.

If I reschedule a Blueprint Day twenty-one (21) days prior to the scheduled event, I acknowledge and agree that The Scheduling Institute will charge me a one thousand dollar ($1,000) rescheduling fee, which constitutes a reasonable estimate of the costs The Scheduling Institute will incur to facilitate such rescheduling.  I further acknowledge and agree that, in the event of such rescheduling, The Scheduling Institute will issue me a credit (equal to any payment(s) I have made toward the Blueprint Day less the one thousand dollar ($1,000) rescheduling fee) which I may apply toward the purchase of any new Scheduling Institute product or service (but not toward any balance owed on existing purchases of Scheduling Institute product(s) or service(s)).  I acknowledge and agree that I must use such credit before or on the date of the scheduled event, otherwise such credit will be forfeited.

PROMOTIONAL PRICING

I understand that any promotional pricing cannot be combined with any other offers or membership discounts. I understand that there are no refunds on previous purchases.

RETURN POLICY

I understand that if I am unsatisfied with my purchased Media Product after one year, I can return my product for a full refund, but no sooner.
